These Terms of Use (“Terms”) govern your access to and use of services provided by New Building Corporation (“we”, “us”, “our”), including our mobile applications and related services (the “Services”). By using the Services, you agree to these Terms.
You must be at least 13 years old (or the age required by law in your region) to use the Services.
We provide mobile applications and features, including tools that may analyze user-provided content (such as photos). Some features may be available without an account, while other features may allow or require sign-in (for example, Sign in with Apple and/or Google). We may update, modify, or discontinue parts of the Services at any time.
Some features require a paid subscription (for example: weekly, monthly, and/or annual; plans may vary by app, region, and promotional offer, and some apps may offer free trials). A subscription unlocks access to all features available under your plan. Purchases are processed by the platform provider (Apple App Store and, where applicable, Google Play) and are subject to the provider’s terms and policies. Renewals, cancellations, and refunds are handled through your platform account settings.
Where subscriptions are available through Apple In-App Purchases, your subscription may automatically renew unless canceled at least 24 hours before the end of the current period, in accordance with Apple’s rules. You can manage or cancel your subscription in your Apple ID settings. Refunds (if any) are handled by Apple under Apple’s policies.
The Services may include AI-powered analysis of images, content, or other inputs and may rely on third-party AI providers. You acknowledge and agree that AI outputs may be inaccurate, incomplete, or incorrect; AI outputs are provided “as is” for informational purposes only; and you are solely responsible for how you use AI outputs.
If any Service feature relates to nutrition, calories, or wellness, it is not medical advice and is not a substitute for professional consultation.
You may provide content to the Services (e.g., photos and, where applicable, videos) to use certain features. You retain ownership of your content. Photos are stored on your device by default.
AI processing. To provide features such as AI analysis, we may process your media (including photos/images and, where applicable, videos) and may (i) upload your image(s) to a third‑party image hosting provider (currently imgbb) to generate an image link and (ii) share the media and/or link with third‑party AI providers/aggregators to generate the requested output (for example, providers such as OpenAI, Nex AI, and Kimi). Third‑party providers may process your content under their own terms and policies.
You grant us a limited, non-exclusive, worldwide license to host, process, reproduce (solely as technically necessary), and transmit your content only to operate the Services and provide the features you request (including sending content to third‑party processors when needed for AI analysis).
You represent and warrant that you have the rights to the content you upload and that it does not violate applicable law or third‑party rights. Do not upload confidential, sensitive, or personal information you are not comfortable sharing with third‑party processors.

The Services may rely on third‑party services (for example, Firebase (Analytics/Crash reporting), Amplitude, AppsFlyer, platform stores, push delivery services, image hosting providers, and AI providers). We are not responsible for third‑party services and their terms or policies. Your use of third‑party services may be governed by their own terms.
The Services, including software, designs, and branding, are owned by New Building Corporation or its licensors and are protected by law.
The Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non‑infringement. AI-generated results may be inaccurate or incomplete and should not be relied upon as professional advice.
To the maximum extent permitted by law, New Building Corporation will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising out of your use of the Services.
To the maximum extent permitted by law, New Building Corporation’s total liability for any claim arising out of or relating to the Services will not exceed the amount you paid (if any) for the applicable subscription during the three (3) months immediately preceding the event giving rise to the claim, or USD $0 if you paid nothing.
To the extent permitted by law, you agree to indemnify and hold harmless the Company from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the Services; (b) your content; or (c) your violation of these Terms, applicable law, or any third-party rights.
You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of assets.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
These Terms, together with any policies or guidelines referenced herein (including our Privacy Policy), constitute the entire agreement between you and the Company regarding the Services and supersede any prior or contemporaneous agreements and communications.
You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or to protect the Services.
Sections that by their nature should survive (including intellectual property, disclaimers, and limitations of liability) will survive termination.
We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Continued use after changes means you accept the updated Terms.
These Terms are governed by the laws of the Republic of Armenia, without regard to conflict-of-law principles. Any disputes arising out of or relating to these Terms or the Services shall be resolved in the competent courts of the Republic of Armenia, unless mandatory local law provides otherwise.
